REFERRING PARTICIPANTS

How to participate – Referring Participants

To participate in the Promotion, each Referring Participant must:

1. have:
   • previously purchased land directly from the Promoter and have settled that purchase;
   • have exchanged binding contracts to purchase land from the Promoter;
   • entered into a site agreement for a land lease community with the Promoter which is current at the date of the referral; or
   • paid a holding deposit to the Promoter to secure a residential lot / a home for a land lease community site prior to entering into binding contracts;
2. during the Promotional Period, refer a new customer to the Promoter by completing the Promoter’s “AVIDRewards (Referral) Form” and submitting online at www.staging2.avid.com.au/avidrewards/ before the referred party submits an enquiry either via email, online, phone or in person at the Promoter’s Sales and Information Centre; and
3. otherwise meet the Eligibility Criteria.

Eligibility Criteria – Referring Participant

The Referring Participant’s eligibility to receive an AVIDReward (Referral) is subject to:

1. the Referring Participant referring a referred party to the Promoter (Referred Participant)
2. a completed online “AVIDRewards (Referral) Form” (available on our website www.staging2.avid.com.au/avidrewards/) being submitted to Promoter before the Referred Participant submits an enquiry either via email, online, phone or in person at the Promoter’s Sales and Information Centre at any Qualifying Land;
3. the Promoter being satisfied (in its absolute discretion) that the Referred Participant is a “new introduction” and was not:
   • in the Promoter’s database prior to the Referring Participant contacting the Promoter; and
   • previously in the Promoter’s database within the last 5 years;
4. the Referred Participant entering into a Contract of sale for a lot / home purchase agreement for a new dwelling for a land lease community site in Qualifying Land within 12 months after submission of the “AVIDRewards (Referral)” Form to the Promoter;
5. the Referred Participant successfully completing an eligible purchase of a lot in the Qualifying Land in accordance with the terms of the Contract for sale / completing an eligible home purchase agreement for a land lease community site in Qualifying Land (as the case may be); and
6. where applicable, the Referring Participant must disclose any benefit or reward to any financier as required and must obtain its own independent legal and financial advice.

The Promoter reserves the right, in its absolute discretion, to:

1. take all necessary steps to verify the validity of a Referred Participant; and
2. verify the eligibility of a Referring Participant to receive the AVIDReward.

In the instance of more than one Referring Participant referring the same referred party, the first “AVIDRewards (Referral) Form” that is received and acknowledged by an AVID Sales Consultant will be considered for the purposes of the Promotion.

For the avoidance of doubt, AVIDReward (Referral) will only apply to an eligible purchase of new dwellings for a land lease community where the Promoter is the vendor under the home purchase agreement.

Licensed or professional builders and their employees or agents are not eligible to be Participants or to receive an AVIDReward (Referral).

AVIDReward (Referral)

Subject to these Terms and Conditions, the Referring Participant will be eligible to receive one (1) Prezzee Smart eGift Card to the value of $1,500 (including GST).

The gift card supplier’s terms and conditions can be viewed at https://www.prezzee.com.au/. The gift card expires on the date that is 36 months from the date of issue.

The gift card cannot be used in certain retail outlets.

The Promoter does not accept any liability or assume any responsibility in any way arising out of, or in relation to, the use of the gift card, or for any card faults or defects or if the Buyer is unable to use the gift card for any reason including if the gift card is damaged or lost.

Each participant is responsible for informing their lender (if any) about the gift card.

Are there any restrictions or limitations on the AVIDReward (Referral)?

There is only one AVIDReward (Referral) available for each Contract for a specific lot or home purchase agreement for a specific land lease community site in Qualifying Land irrespective of:

• the number of Referring Participants claiming eligibility;
• the number of referred parties purchasing any particular lot or home for a specific land lease community site, of the Qualifying Land under that contract; or
• the number of Qualifying Land lots being purchased in the Contract.

In the event that a referred party is referred by more than one Referring Participant, only the first Referring Participant to refer the referred party will be eligible to receive the AVIDReward (Referral), as determined by the Promoter in its absolute discretion.

Collection of AVIDReward (Referral)

Eligible Referring Participants will receive their referral confirmation via email to the address provided at time of signing the “AVIDRewards (Referral) Form”.

The AVIDReward (Referral) will be payable within 30 days after the last to occur of the Referring Participant and the Referred Participant’s settlements (Promotion Collection Date).

If for any reason the Promoter is unable to contact the Referring Participant or the Referring Participant fails to provide any details necessary to effect payment of the AVIDReward (Referral) within 90 days of the Promotion Collection Date, then the AVIDReward (Referral) will be forfeited and the Referring Participant that could not be contacted or fails to collect the AVIDReward (Referral), will have no claim against the Promoter..

REPEAT PURCHASER PARTICIPANTS

How to participate – Repeat Purchaser Participants

To participate in the Promotion, each Repeat Purchaser Participant must:

1. have previously purchased land directly from the Promoter and have settled that purchase, or have exchanged contracts to purchase land from the Promoter;
2. sign and exchange a further Contract of sale for a residential lot in the Qualifying Land during the Promotional Period; and
3. pay the deposit required under such Contract of sale in accordance with its terms.

Eligibility Criteria – Repeat Purchaser Participant

The Repeat Purchaser Participant’s eligibility to receive an AVIDReward (Repeat Purchaser) is subject to the Repeat Purchaser:

• having previously purchased and settled a lot from the Promoter at Qualifying Land or entered into a home purchase agreement or site agreement for a land lease community site for Qualifying Land; and
• entering into a contract for a further eligible purchase of a lot /home purchase agreement for a land lease community within the Qualifying Land, within the Promotional Period.

The Repeat Purchaser Participant must satisfy the following:

• the purchase must be made directly with an AVID Sales Consultant and must not involve any marketing or third party agent;
• a completed online “AVIDRewards (Referral) Form” (available on our website https://staging2.avid.com.au/avidrewards/) must be submitted to Promoter either before, or at the time of execution of an eligible Contract for sale;
• the Repeat Purchaser Participant must provide proof (if requested by AVID) that it has previously purchased and settled a lot /home purchase agreement in Qualifying Land within the Promotional Period; and
• where applicable, the Participant must disclose any benefit or reward to any financier as required and must obtain its own independent legal and financial advice.

The Promoter reserves the right, in its absolute discretion, to:

• take all necessary steps to verify the validity of previous purchase; and
• verify the eligibility of a Repeat Purchaser Participant to receive the AVIDReward (Repeat Purchaser).

For clarity, a Repeat Purchaser Participant who has bought and settled land in “Covella” in accordance with the terms of the Contract during the Promotional Period will (subject to meeting all other eligibility requirements) be entitled to an AVIDReward (Repeat Purchaser) on the basis that:

• the subsequent purchase is for Qualifying Land (that is, not land in “Covella”);
• the subsequent purchase is made directly with an AVID Sales Consultant and does not involve any marketing or third party agent;
• a completed online “AVIDRewards (Referral) Form” (available on our website https://staging2.avid.com.au/avidrewards/) has been submitted to Promoter either before, or at the time of execution of an eligible Contract for sale;
• the Repeat Purchaser Participant has provided proof (if requested by AVID) that it has previously purchased and settled a lot in “Covella” within the Promotional Period; and
• where applicable, the Repeat Purchaser Participant must disclose any benefit or reward to any financier as required and must obtain its own independent legal and financial advice.

For the avoidance of doubt, AVIDReward (Repeat Purhcaser) will only apply to an eligible purchase of new dwellings for a land lease community where the Promoter is the vendor under the home purchase agreement.

Licensed or professional builders and their employees or agents are not eligible to be Participants or to receive an AVIDReward (Repeat Purchaser).

AVIDReward (Repeat Purchaser)

Subject to these Terms and Conditions, the Repeat Purchaser Participant will be eligible to receive one (1) Prezzee Smart eGift Card to the value of $3,000 (including GST).

Are there any restrictions or limitations on the AVIDReward (Repeat Purchaser)?

There is only one AVIDReward (Repeat Purchaser) available for each contract for a specific lot / home purchase agreement for a specific land lease community site in Qualifying Land irrespective of:

• the number of Repeat Purchaser Participants claiming eligibility under a Contract for sale/ home purchase agreement; or
• the number of lots /homes within the Qualifying Land if multiple lots are being purchased in one Contract for sale.

Collection of AVIDReward (Repeat Purchaser)

The AVIDReward (Repeat Purchaser) will be applied at settlement of the last lot/home purchase of Qualifying Land to settle.

Terms and Conditions Section 1 – General

1. Information on how to participate in the Promotion and AVIDReward details form part of these terms and conditions.

2. By participating in the Promotion, Referring Participants and Repeat Purchaser Participants accept and agree to be bound by these terms and conditions. For the avoidance of doubt, these terms and conditions include the Schedule above.

3. Referring Participants and Repeat Purchaser Participants must comply with these terms and conditions to participate in the Promotion.

4. Where there is an inconsistency between the Schedule and Sections 1 to 7 of these terms and conditions the Schedule will prevail.

5. Any dispute in relation to the eligibility to participate in the Promotion or receive the AVIDReward will be determined by the Promoter in its absolute discretion. The Promoters decision will be final and binding on the Referring Participant.

6. AVID reserves the right to vary, limit or cancel these Terms and Conditions or Promotion without notice to Referring Participants and/or Repeat Purchaser Participants.

Terms and Conditions Section 2 – Who can participate

7. The Promotion is not available in conjunction with any other promotion or offer by the Promoter or any related body corporate.
8. If the Schedule permits participants to be under the age of 18 years, such participants must seek permission from their parent or guardian to participate. If the participant is under 18 years of age, the AVIDReward will be provided to the participant’s parent or legal guardian.
9. Directors and employees (and their immediate families) of the Promoter or its related companies or agencies and Participating Retailers are not eligible to participate. Immediate families means spouse, ex-spouse, de facto partner, ex-de facto partner, child, step-child, parent, step-parent, legal guardian, sibling or step-sibling.
10. The Promoter reserves the right to deem any prospective Referring Participant and Repeat Purchaser Participant not eligible to receive the AVIDReward, including if the Promoter reasonably suspects the prospective Referring Participant and Repeat Purchaser Participant is purchasing the AVID Property for a commercial purpose.

Terms and Conditions Section 3 – How to participate

11. To participate in the Promotion, each Referring Participant and Repeat Purchaser Participants must comply with the ‘How to Participate’ section of the Schedule.
12. The Promoter reserves the right, at any time, to request verification of the age, identity, residential address or any other information relevant to participation in the Promotion of all Referring Participants and Repeat Purchaser Participants. The Promoter reserves the right to disqualify any Referring Participant and Repeat Purchaser Participants who provides false information or fails to provide information that is reasonably requested by the Promoter.
13. The Promoter reserves the right, in its sole discretion, to disqualify any Referring Participant and Repeat Purchaser Participants who has:
    1. provided incomplete, indecipherable and/or offensive material as part of their participation in the Promotion,
    2. breached any of these terms and conditions; and/or
    3. contravened any applicable laws or regulations or otherwise engaged in unlawful or improper conduct.

14. The eligibility of Referring Participants and Repeat Purchaser Participants to receive an AVIDReward is solely within the discretion of the Promoter.
15. The Promoter accepts no responsibility for late, lost or misdirected communications.
16. If participation in the Promotion is online, by telephone or SMS, the Promoter assumes no responsibility for any failure to receive any information or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the Promotion.
17. If participation in the Promotion requires access to Facebook, Referring Participants and Repeat Purchaser Participants acknowledge and agree that use of Facebook is subject to Facebook’s terms and conditions. The Promoter is not responsible or liable for any loss, damage or injury suffered by any Referring Participant as a result of the conduct of Facebook, including any decision by Facebook to remove or not remove any content, except for liability which cannot be excluded by law. The opinions and images uploaded on Facebook as part of this Promotion are not necessarily endorsed or supported by the Promoter and the Promoter does not confirm, guarantee or warrant their accuracy.
18. If participation in the Promotion requires access to Instagram, Referring Participants and Repeat Purchaser Participants acknowledge and agree that use of Instagram is subject to Instagram’s terms and conditions. The Promoter is not responsible or liable for any loss, damage or injury suffered by any Referring Participant as a result of the conduct of Instagram, including any decision by Instagram to remove or not remove any content, except for liability which cannot be excluded by law. The opinions and images uploaded on Instagram as part of this Promotion are not necessarily endorsed or supported by the Promoter and the Promoter does not confirm, guarantee or warrant their accuracy.

Terms and Conditions Section 4 – Incentives (AVIDReward)

19. Each AVIDReward is not transferrable, exchangeable, or redeemable for cash.
20. If any AVIDReward is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the AVIDReward with an incentive of equal or greater monetary value. This right is subject to any applicable legislation, regulations or directions from a regulatory authority.
21. All taxes (excluding GST, if any) which may be payable as a consequence of receiving an AVIDReward are the sole responsibility of each Referring Participant and Repeat Purchaser Participants.
22. The Referring Participant and Repeat Purchaser Participant’s use of the AVIDReward is entirely at their own risk. Before the AVIDReward is provided, the receiver of the AVIDReward may be required to sign an agreement to release the Promoter from and indemnifying the Promoter against any liability arising from or in connection with the AVIDReward.
23. Once the AVIDReward has left the Promoter’s premises, the Promoter takes no responsibility for the AVIDReward being damaged, lost or stolen.
24. The Referring Participant may not deduct or set off the value of the AVIDReward from any moneys or debts payable to the Promoter.
25. Any taxies, duties, levies or similar charges payable in relation to the receipt of the AVIDReward are assigned to and are the responsibility of the Referring Participant and Repeat Purchaser Participant.
26. The AVIDReward is not payable where the application of the AVIDReward:
    1. results in a “zero deposit” or similar sale which requires the Promoter to make a financial contribution to the purchaser; or
    2. is a nomination to another purchaser of the Contract of sale after the cooling off period has expired; or
    3. the genuine purchaser referred to in paragraph 24(b) is already a member of the Promoter’s database.

27. The AVIDReward is not payable where the Referring Participant and Repeat Purchaser Participant fails to settle the purchase in accordance with the terms of the Contract for sale.

Terms and Conditions Section 5 – Receiving the Incentive

28. Subject to these Terms and Conditions each eligible Referring Participant and Repeat Purchaser Participant that complies with these terms and condition will receive the AVIDReward.
29. The eligibility of Referring Participant and Repeat Purchaser Participant’s to receive the AVIDReward is solely within the discretion of the Promoter.
30. The Promoter reserves the right to request each Referring Participant and Repeat Purchaser Participant to provide proof of their identity and/or proof that they were responsible for participating in the Promotion.
31. Each Referring Participant and Repeat Purchaser Participant agrees to participate and cooperate, as required, in all publicity activities relating to the Promotion, including, without limitation, being interviewed, photographed, filmed and recorded. Each Participant authorises the Promoter to use such content for advertising and publicity purposes in any media in perpetuity worldwide.
32. It is the responsibility of each Referring Participant and Repeat Purchaser Participant to notify the Promoter of any change to their contact details.
33. The Promoter may vary or withdraw and Qualifying Property from the Promotion or vary the Promotion Period. The Promoter may also with prior notice, make reasonable variations to the terms of the Promotion.
34. All information provided is subject to change without notice. Referring Participant and Repeat Purchaser Participant should make their own enquiries and satisfy themselves as to whether the information provided is current and correct and if appropriate, seek appropriate advice before making the referral.

Terms and Conditions Section 6 – Limit on Liability

35. Any AVIDReward supplied by a third party supplier is subject to the terms and conditions of that third party supplier. The AVIDReward may come with guarantees that cannot be excluded under the Australian Consumer Law. If those guarantees are not complied with, then the Referring Participant and Repeat Purchaser Participant will have rights under the Australian Consumer Law. Subject to those guarantees and rights, the Promoter shall not be liable and excludes all liability (including negligence), for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for damage to property, personal injury or death suffered or sustained in connection with this Promotion or the use or taking of any AVIDReward except for any liability which cannot be excluded by law including as provided for under the Australian Consumer Law.
36. By entering into this Promotion, the Referring Participant and Repeat Purchaser Participant is indicating its agreement to be bound by these Terms and Conditions.
37. In consideration for the Promoter entering into a Contract for sale with the Referring Participant and Repeat Purchaser Participant and offering an AVIDReward in accordance with this Promotion the Referring Participant agrees to release and indemnify the Promoter and each of its officers, employees and agents in respect of all claims, liabilities, losses and causes of action whatsoever arising directly or indirectly out of or in connection with the AVIDReward.
38. To the extent permitted by law, AVID takes no responsibility and will not be held liable by any Member or Customer for any direct, indirect or consequential loss arising out of our in connection with Referring Participant and Repeat Purchaser Participants participation in the AVIDRewards Club.
39. To the maximum extent permitted by law, the Promoter gives no warranty and makes no representation as to the accuracy or sufficiency of any description, illustration, photograph or statement contained in any advertisement relating to the Promotion, or any information or statements made or given by its employees, agents or contractors concerning the Promotion, and, except for any liability which cannot be excluded by law, will not be liable for any loss or damage suffered or incurred by any party who relies upon the information in any such Promotion, advertisement, publication or statement

Terms and Conditions Section 7 – Privacy

40. The Promoter will collect, use and disclose each Referring Participant, Referred Participant and Repeat Purchaser Participant’s personal information for the purposes of:
    1. conducting the Promotion (which may include disclosure to third parties for the purpose of processing and conducting the Promotion) and for promotional purposes, public statements and advertisements in relation to the Promotion;
    2. providing information to the Referring Participants, Referred Participants and Repeat Purchase Participants about the products and services offered by the Promoter and its related companies; and
    3. research to improve its products and services.
41. By participating in the Promotion, Referring Participants, Referred Participants and Repeat Purchaser Participants consent to the use of their personal information as described in these terms and conditions.
42. Any personal data relating to the Referring Participant, Referred Participant and Repeat Purchaser Participants or any other entrants will be used solely in accordance with current Australian data protection and privacy legislation, and in accordance with the AVID Privacy Policy https://staging2.avid.com.au/privacy-policy.
43. Referring Participant, Referred Participants and Repeat Purchaser Participants may access, change, opt out and/or update their personal information in accordance with the Promoter’s privacy policy https://staging2.avid.com.au/privacy-policy.
44. This is the current version of the promotion Terms and Conditions as of 2 April 2026 and supersedes all early versions of these Terms and Conditions.
